Default appeals after conviction....???
hello,
please suggest, if the Appellant appeals after conviction and wins, can he/she be retried? thanx!

If the appellate court overturn the conviction, they can dismiss the case or they can remand it and allow the original prosecutor to decide whether or not to retry it.
